Service Terms and Conditions

Payment: Bookings will only be confirmed once full payment has been received. PLEASE NOTE***Full payment due 7 days prior to departure.
Cancellations by client: Cancellations must be in writing (e-mail acceptable) by the persons signing the booking form and are not effective until confirmed as received by the Company. If the cancellation is received more than 7 working days prior to departure, the deposit will be refunded, less banking charges. The country at the time of presenting payment options to the customer is South Africa. Transaction Currency is South African Rand (ZAR). Whale Watchers will not take responsibility for any difference in exchange rates between the payment and refund dates. If the cancellation is received within 7 working days of departure, a further charge of 50% of the full tour fare will apply. NO REFUND - cancellation 24 hours before the trip. The Whale Watchers may cancel or postpone a trip due to bad weather. PLEASE NOTE THERE IS NO REFUND FOR NO SIGHTINGS.
Cancellations by the Whale Watchers: Whale Watchers reserves the right to, in any circumstances, cancel the trip. In instances where the Company cannot run the trip, all monies paid by the client will be refunded and this will constitute the full extent of the company’s liability. Whale Watchers will not take responsibility for any difference in exchange rates between the payment and refund dates. Indemnity form to be signed on arrival. The Whale Watchers will not be responsible for, or liable for any loss or damages of property.

Return and Refunds policy
The provision of goods and services by Whale Watchers is subject to availability. In cases of unavailability, Whale Watchers go to every endeavor to rebook/reschedule the service. If that is not possible, it will be considered to refund the client soon as possible. THE WHALE WATCHERS GIVE NO REFUND INCASE OF NO SIGHTINGS ON A TRIP.
Customer privacy policy
Whale Watchers shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted
Payment may be made via Visa, MasterCard, credit cards for online bookings. Bank transfers or cash will only be accepted for direct bookings into the Whale Watchers bank account, the details of which will be provided on request
Credit card acquiring and security
Credit card transactions will be acquired for Whale Watchers via PayGenius who are the approved payment gateway. PayGenius uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygenius.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Whale Watchers separately from card details which are entered by the client on PayGenius’s secure site. For more detail on PayGenius refer to www.paygenius.co.za

Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
Whale Watchers takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods
Country of domicile
This website is governed by the laws of South Africa and Whale Watchers chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Variation
Whale Watchers may, in its sole discretion, change this agreement or any part thereof at any time without notice.
